Case Results (Settlements & Verdicts)

The amount of any verdict or settlement in any personal injury claim, whether it is a motor vehicle accident, medical malpractice case or otherwise, depends on the facts and circumstances of that specific case. Therefore, the verdict or settlement of one case does not necessarily reflect the value of any other case. However, the following are some of the verdicts and settlements which Wilson, Updike & Nicely has obtained for its clients in recent years. At Wilson, Updike & Nicely, we understand and emphasize client privacy and therefore, all names or other identifying references related to the cases listed below have been withheld.

• $1,500,000.00 Verdict:   Medical malpractice case involving a client who had a breast reduction that resulted in loss of both breasts. No offer of settlement was made prior to trial.
• $1,250,000.00 Settlement: Medical malpractice case involving a patient who was the victim of two separate acts of malpractice. Case was settled against both medical providers for a combination of $1,250,000.00.
• $1,200,000.00 Settlement: Products liability case involving a client who suffered burns as the result of an improperly designed piece of industrial equipment.
• $1,000,000.00 Verdict:  Pedestrian sustained multiple injuries after being struck by an automobile in parking lot of grocery store.
• $850,000.00 Award:  Medical malpractice case involving a client who sustained permanent nerve injuries as the result of the improper performance of vascular surgery. Award obtained through binding arbitration.
• $800,000.00 Settlement:   Medical malpractice case involving multiple surgeries that were improperly performed.
• $775,000.00 Verdict:  Tractor-trailer case involving a client who sustained permanent injuries. This case was initially dismissed by the trial court but successfully appealed to the Virginia Supreme Court, which granted Plaintiff a second trial resulting in the $775,000.00 verdict.
• $750,000.00 Verdict:  Nursing Home negligence case involving a client who fell. This case is one of the largest personal injury verdicts in the history of Alleghany County.   
• $750,000.00 Settlement:  Medical Malpractice case where a physician ordered that test results be read and reported immediately, but no report was received and physician did not check on the results.
• $700,000.00 Settlement: Products liability case involving a client who was injured on the job when a large piece of concrete pipe suddenly broke apart while being lifted.
• $600,000.00 Settlement:  Motor vehicle collision where client sustained a back injury after his vehicle was struck in a parking lot by a delivery van.
• $400,000.00 Settlement: Medical malpractice case where baby died before birth as the result of improper prenatal testing.
• $325,000.00 Award:  Motor vehicle collision in which underage passenger was injured by driver with a .31 BAC. Client had approximately $11,000.00 in past medical bills and award included punitive damages.

Although the results in any previous case do not necessarily guarantee a particular result in another case, the above cases illustrate that our firm has a proven track record of success, both at trial and in out-of-court settlements.
